Terms of Use – BIS CRM & DPOSaaS

Conditions governing access to BIS CRM platforms and training content (standard access period: 12 months).

1. Acceptance of the Terms

These Terms of Use govern access to and use of the websites, platforms, applications, and services provided by BIS CRM, including the DPOSaaS platform and the training environment for privacy, data protection, information governance, artificial intelligence, and compliance content. By accessing, registering for, or using any functionality, you confirm that you have read, understood, and agreed to these Terms.

2. About the Platform

BIS CRM provides technological, methodological, and educational solutions to support compliance with data protection regulations and best practices in privacy, information security, and governance. Services may include:

  • Access to courses, training programmes, and educational content
  • Professional training programmes, certifications, and licences
  • Tools supporting compliance and privacy management
  • Resources for individual users, companies, and public-sector organisations

3. Eligibility and Registration

To access certain functionalities, users must meet the following conditions:

  • Have legal capacity to enter into binding agreements
  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of access credentials

Users are responsible for all activities carried out under their accounts.

4. Permitted Use of the Platform

The platform may only be used for lawful, educational, and professional purposes in accordance with these Terms and applicable laws. The following activities are strictly prohibited:

  • Using the platform for unlawful or fraudulent purposes
  • Sharing, reselling, or transferring access without authorisation
  • Copying, reproducing, distributing, or commercially exploiting the content
  • Attempting to access restricted areas, systems, or third-party data
  • Interfering with the technical operation or security of the platform

Violations may result in suspension or termination of access and any other legal measures available.

5. Intellectual Property

All content—including texts, videos, training materials, methodologies, trademarks, logos, software, and layouts—is the property of BIS CRM or its licensors. Access does not grant any intellectual property rights, and any use beyond the authorised limits is prohibited.

6. Plans, Payments, and Access Period

Certain services are offered on a paid basis. Conditions may vary depending on the product (individual, corporate, licences, or subscriptions) and cover access type, pricing, payment methods, and renewal terms. The standard access period for training content is 12 months unless stated otherwise. After this period, access may end, renew, or migrate per the applicable commercial conditions. Unless expressly stated otherwise, fees are non-refundable once access begins.

7. Training, Certifications, and Content Updates

7.1 Evolving Nature of Content

Training courses and certifications reflect the state of knowledge and legislation at the time they are published. Content may become outdated due to legal, technological, or regulatory changes.

7.2 Updates, Replacement, or Discontinuation

BIS CRM may update, replace, or discontinue training content, including during the contracted access period, to preserve technical accuracy and regulatory alignment. Discontinued content may be removed from the platform, and continued access to previous versions is not guaranteed.

7.3 Transition Policy in Case of Discontinuation

If content is discontinued due to obsolescence or technical updates, the following compensatory measures apply:

  • Users already certified: 25% discount on the purchase of the new or updated equivalent training.
  • Users not yet certified: 75% discount on the purchase of the new or updated equivalent training.

These benefits are compensatory, non-transferable, non-refundable, and do not entitle users to reimbursement of previous payments.

7.4 No Refund Policy

Discontinuation due to obsolescence is not a failure to provide the service. Access was delivered as contracted, and updates prevent reliance on outdated practices. No refunds will be provided in such cases.

8. Platform Availability

BIS CRM endeavours to maintain platform availability and security but cannot guarantee uninterrupted or error-free operation. Content and functionalities may be updated, modified, or discontinued for technical, legal, or operational reasons. Maintenance or corrective interventions may occur during the contracted period when necessary.

9. Limitation of Liability

To the maximum extent permitted by law, BIS CRM is not liable for:

  • Damages resulting from improper use of the platform
  • Decisions made solely based on the educational content
  • Temporary interruptions or unavailability of the platform
  • Third-party content or services integrated into the platform

Use of the platform is at the user’s own risk, within the limits established by law.

10. Personal Data Protection

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

11. Suspension and Termination

BIS CRM may suspend or terminate user access in cases of breach of these Terms, improper use of the platform, or to comply with legal and regulatory requirements. Users may request account termination via the available procedures, and outstanding payments remain due.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales for users subject to the UK GDPR, or the laws of an EU Member State where mandatory consumer protection rules apply, without prejudice to statutory rights. Nothing in these Terms limits mandatory rights available under applicable EU or UK law.
